Monday News Update

GARLANDS INDICTED
The Calloway County coroner was indicted Friday on charges of official misconduct and marijuana possession. Mike Garland was indicted for cultivating more than five marijuana plants; theft of a controlled substance over $300; possession of marijuana (firearms enhanced); possession of drug paraphernalia (first offense-firearms enhanced); first-degree possession of a controlled substance (first offense); and theft of a legend drug (perscription drug) under $300 (first offense), all Class D felonies. He was also indicted for third-degree possession of a controlled substance (first offense) and first-degree official misconduct, both Class A misdemeanors. His wife, Tina Garland was indicted for possession of marijuana and possession of drug paraphernalia (first offense firearms enhanced); both Class D felonies. The Garlands were arrested Sept. 3 after a raid by state police. The Garlands are scheduled for arraignment Nov. 10, in Calloway Circuit Court. Garland has not resigned as coroner.

CALLOWAY AND MURRAY BANDS ADVANCE
Eighty Kentucky high school bands, including both local bands, advanced Saturday from the quarterfinals of the KMEA State Marching Band Championship to the semifinal round. The Calloway County High School Band was one of four bands awarded a Distinguished Rating and was ranked third overall at the 4A competition Saturday at Warren East High School. The semifinals will be Saturday at venues in and around Louisville. Murray High will compete in Class A at Butler High School and Calloway County will compete in the 4A contest at South Oldham High School. Bands compete in five classes from A for small schools to AAAAA for the largest schools. Of the 80 bands advancing to semifinals, the four top-scoring bands from each class, for a total of 20, will compete in the finals, starting at 6 pm Saturday at Papa John's Cardinal Stadium. The top band in each class will then be awarded the Governor's Cup.

MURRAY GETS PELLA MONEY
Through a recent $5,000 donation from Pella Corporation to Murray High School, four new glass backboards and breakaway rims have been installed on the main playing floor and on the alternate side goals inside the MHS gym. This new upgrade has replaced the former wooden backboards, that had existed since the goals were originally added. Murray High School athletic director David Fields said this has been a much-needed change, and they cannot thank Pella Corporation enough for the tremendous donation.

TVA WORK CONTINUES
TVA utility line work on I-24 in Marshall County will continue today. Work is expected to resume at noon near the 21 mile marker where utility crews are replacing power lines over the roadway. Police are monitoring traffic in the area. Appropriate caution is advised. TVA personnel expect to be working along the Interstate another day or two at this site.

READING RECOVERY CENTER
Dr. Judy Embry, Trainer and Director of the University of Kentucky Collaborative Center for Literacy, Development, Reading Recovery Center, visited East Calloway Elementary on Friday to participate in professional development classes for Reading Recovery teachers from western Kentucky.  At that time, a one-way glass window in the East Calloway Reading Recovery classroom was used.  The window was recently built as part of the UK program to observe the progress in those participating in the recovery program.

MURRAY MAN CHARGED AFTER WRECK
Friday David Todd was operating his vehicle on Radio Road when he lost control of the car damaging property before overcorrecting and the vehicle going airborne and overturning.  The vehicle came to final rest on its top off the right side of the road in front of Hudson's Body Shop.  Todd was then pulled from the vehicle by two witnesses before the vehicle caught on fire Todd fled the scene prior to police arriving.  He was later located behind Hudson's Body Shop.  He was taken to the hospital where he was treated and released for his injuries.  Todd was taken into custody and charged with Dui 1st and also leaving the scene of an Accident.

ESCAPEES CAPTURED
On Friday just before midnight the Kentucky State Police in Elizabethtown apprehended the two inmates that had escaped from the Fulton county detention center last week.  The two state inmates, Jeremy Phelps and Tommy Lee Southard, are suspected of stealing a van in Fulton on Wednesday.  The van was recovered, abandoned, in the afternoon hours of Thursday.  In the early morning hours of Friday, Lyon County Sheriffs Office received a report of a stolen pickup truck from Batesville Casket Company in Eddyville.  The truck that was stolen by the inmates was equipped with a GPS tracking device that led investigators to the whereabouts of where the vehicle was abandoned in the Louisville Metro area.  With the assistance of the Fulton Police Department, Lyon County Sheriffs Department, and the Louisville Metro Police Department, Kentucky State Police were able to track a general vicinity of where the fugitives were possibly located.  Authorities responded to the residence and set up a perimeter around the residence.  After a brief stand off, both suspects surrendered to KSP troopers without incident. 

TODD APPEALS SMOKING BAN IN PADUCAH
An appeal by Paducah business owner Dickie Todd has McCracken Circuit Judge Jeff Hines saying he will rule within two weeks on the legality of a smoking ban in most public places in the city limits of Paducah. He's re-considering the case of Todd the owner of Side Pockets Billiards, who is challenging Paducah's smoking ban that argues the city's ban regulated the use of his property and therefore required approval of the city's planning commission.

SERVICES SET FOR MURDER VICTIMS
Funeral services for the victims of a triple murder have been scheduled for later this week. 17-year-old Kayla Williams, 14-year-old Kortney Frensley and 5-year-old Ethan Frensley were killed last week at their home in Roaring Springs.  Their mother Kristy Frensley survived the attack. A memorial fund has been established at Integra Bank in Cadiz, KY for the Frensley family. Dunlap made his first appearance in person on Friday to face his accusers. The defendant sat expressionless with his head bowed for most of the proceeding. Friends and family watched as detective Jerry Jones with the Kentucky State Police testified that Kristy Frensley was in her backyard doing lawn work when Dunlap approached her, armed and claiming that he needed to get things out of the house. Investigators discovered guns, zipties and sneakers coated with blood and ash in the home of the Dunlap.

BOWLING GREEN CATCHES FISH
A minor league baseball team moving to southern Kentucky will unveil it's name, logo and colors at a press conference today. The team will play in a new stadium in Bowling green in 2009 as the Class-A South Atlantic League affiliate of the Tampa Bay Rays. The announcement is scheduled for 5:30 p.m. CDT at Circus Square Park in Bowling Green. The team is moving from Columbus, Ga., where it was called the Catfish.


GUNNER ARRANGEMENTS MADE
The funeral arrangements for Gunner Gillespie have been finalized. Gillespie was diagnosed with an inoperable brain tumor last November. The eight-year-old passed away at his home Thursday afternoon. Gunner's memorial service will be Monday, November 3, at the Calvert City United Methodist Church.  The service begins at 6:00 p.m. People are asked to contribute to Gunner Gillespie's Magic Train Memorial Fund at Community Financial Services Bank ,P.O Box 467, in Benton.

ACROSS KENTUCKY
Georgetown Police are not offering a lot of details about a body that was discovered in the trunk of a car. The state forensic anthropologist and Scott County coroner are trying to determine if the person was killed or died of natural causes and was put in the trunk. The woman was wheelchair bound and police are searching for her brother.

State police are investigating a fatal shooting in Madison County. A 911 call brought police to a home in Eastern Madison County. They discovered one man dead and took two others into custody. Neighbors said a man and his two sons lived in the house on Charlie Norris Road.

Some Kentucky democratic leaders are hoping to convince Senator Hillary Clinton to come back to Kentucky this week lend her support to Bruce Lunsford and Davis Boswell. "WHAS TV" reports the politicians hope Clinton will campaign in the Louisville/ Elizabethtown area on Friday or Saturday.

A fire destroyed a house in Dayton and damaged two other houses nearby. An electrical problem may have started the original fire, then high winds spread the fire to two adjacent homes. The fire melting siding on those homes. There were no injuries.

A plant in operation for forty years, closes this week. American Standard announced the closing of its plant in Paintsville some time ago. The company has been cutting back the workforce, and now last ten workers are expected to complete the closing this week.
